5 Essential SAG Waivers to Meet Your Commercial Production Needs

The SAG-AFTRA Commercials Contract is designed to protect union talent while offering production teams the flexibility to hire them fairly and efficiently. But let’s face it: not every production fits into a one-size-fits-all approach. Commercial projects often come with unique challenges—whether it’s shooting in a specific location with tight time constraints, hosting unscripted live events, or capturing authentic interviews in sensitive environments like hospitals. These scenarios can make adhering to standard contract guidelines tricky.

Thankfully, SAG-AFTRA understands that productions can be as diverse as the stories they tell. That’s why they offer specific waivers tailored to help production teams address these unique situations while maintaining compliance and cost-efficiency. Whether you’re navigating a complex setup or seeking to reduce talent costs without compromising quality, these waivers can be game-changers.

In this blog, we’ll break down five essential SAG-AFTRA waivers that provide the flexibility you need to tackle the unexpected, stay on budget, and deliver exceptional results. Let’s dive in.

Understanding SAG Waivers in Commercial Productions

SAG-AFTRA waivers are specialized provisions designed to address circumstances where standard union rules may not align perfectly with a production's needs. They allow production teams to modify certain requirements of the SAG-AFTRA Commercials Contract, offering flexibility without compromising the protections or compensation due to union talent.

In this section, we’ll delve into the purpose of SAG waivers, how they benefit commercial productions, and the types of scenarios where they can be most impactful. By getting familiar with these options, you’ll be better equipped to make informed decisions and maximize the potential of your production.

Why SAG Waivers Matter for Your Commercial

SAG waivers aren’t just a convenience—they’re a bridge that helps align the interests of producers and union talent. By addressing the specific challenges of commercial productions, these waivers ensure a smoother, more efficient process for everyone involved. Here’s how:

For Producers: Flexibility and Cost Savings

Productions often face tight budgets, rigid schedules, and unique location demands. SAG waivers provide producers with:

  • Cost Control: Waivers can reduce expenses tied to overtime, specific uses of talent, or location constraints, making union talent more accessible within budgetary limits.

  • Creative Freedom: They allow for more flexibility in executing your vision, from live events to on-location shoots that require non-standard hours.

  • Streamlined Compliance: Instead of navigating complex rules that might slow down production, waivers simplify the process, reducing risks of penalties or delays.

  • Efficient Problem-Solving: When unexpected challenges arise, waivers act as tailored solutions that keep the production moving forward.

For Union Talent: Fairness and Opportunity

Union talent benefits significantly from the thoughtful application of waivers:

  • More Work Opportunities: Waivers help productions that might otherwise avoid union contracts to still hire union performers.

  • Protected Rights: Even with waivers, core protections like fair pay, safety, and benefits remain intact, ensuring that talent is treated ethically and in line with SAG-AFTRA standards.

  • Diverse Productions: By accommodating non-standard productions, waivers create opportunities for union performers to take part in more varied and innovative projects.

A Win-Win for Everyone

SAG waivers foster collaboration between producers and union talent by making union contracts more adaptable without compromising integrity. For producers, this means staying on budget and on schedule; for talent, it means access to more work while retaining the protections they deserve. Together, these waivers create a framework where creativity, compliance, and fairness coexist seamlessly helping bring unique commercial visions to life.

5 SAG Waivers to Meet Your Commercial Production Needs

The SAG-AFTRA Commercials Contract provides 5 waiver options to help advertisers and producers meet unique commercial production demands. These SAG waivers allow adjustments to standard guidelines, ensuring productions remain union-compliant while accommodating specific challenges. Here’s a breakdown of key waivers available and how they can benefit your project:

1. Nights and Weekends Waiver

The Nights and Weekends waiver applies when production schedules are restricted to evenings or weekends, this waiver helps avoid additional premium fees.

Example: A commercial shoot at a school may only be filmed after school hours or on weekends. Normally, such scheduling could incur premium night or weekend rates. This waiver eliminates those extra costs by acknowledging the location’s time restrictions.

2. PSA Waiver

The Public Service Announcements (PSAs) waiver applies for productions using donated media, this waiver exempts productions from paying residuals, provided the media itself is donated. However, to qualify for this waiver, a 501(c)(3) charitable organization must be directly involved in backing the project. Additionally, when requesting the waiver, a 501(c)(3) letter must be sent to SAG-AFTRA as part of the submission process. This ensures the production aligns with the waiver’s intent of supporting charitable causes and donated media initiatives.

Example: A PSA campaign raising awareness for a community initiative can avoid residual costs as long as it qualifies under the union’s guidelines for donated airtime.

3. Section 8D Waiver

This SAG waiver applies to non-union participants essential to the production, particularly in scenarios where their inclusion is critical to the project.

Example: A commercial featuring hospital patients sharing personal stories in interviews can use the Section 8D waiver. To qualify, producers must provide details such as:

  • The number of individuals involved.

  • How participants are selected.

  • Why their involvement is vital to the project.

4. Real People Waiver

Designed for unscripted scenarios, this waiver covers filming real individuals in settings such as live events, "man-on-the-street" interviews, or hidden camera setups.

Example:
Capturing footage from an existing live event or conducting impromptu interviews on the street falls under this waiver. However, it cannot be used to stage scenes; producers must notify the union within 60 days of the first airing.

5. Special Dispensation Waiver

Every production is unique, and some may require waivers outside standard categories. This option considers the specific circumstances of your project to determine whether special accommodations can be made.

Example:
A highly experimental or logistically complex commercial might qualify for this waiver if producers work closely with union experts to make their case.
